Terms of Service

These Terms of Service ("Terms") govern your use of the Vital Tails mobile application ("the App") provided by Sky River Consulting ("we," "our," or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Eligibility

You must be at least 13 years old to use Vital Tails. By using the App, you represent that you meet this age requirement. If you are under 18, you must have permission from a parent or legal guardian to use the App and to make any purchases through it.

2. License to Use the App

We grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on your personal device for your personal, non-commercial use, subject to these Terms.

You agree not to:

• Copy, modify, distribute, sell, or lease any part of the App
• Reverse engineer or attempt to extract the source code of the App, except as permitted by applicable law
• Use the App for any unlawful purpose
• Use the App in any way that could damage, disable, or impair its functionality
• Attempt to gain unauthorized access to any portion of the App or its related systems

3. Not Veterinary or Medical Advice

Vital Tails is a tool for tracking and organizing information about your pet's health, routines, and care. It is not a substitute for professional veterinary advice, diagnosis, or treatment.

You agree that:

• Any information displayed in the App (including suggested calorie goals, reminders, or educational content) is for general informational purposes only
• You should always consult a licensed veterinarian for medical decisions regarding your pet
• We are not responsible for any decisions you make based on information from the App
• The App is not designed for emergency situations — if your pet requires urgent care, contact a veterinarian or emergency animal hospital directly

4. Subscriptions and Payment

a. Vital Tails Premium

Some features of the App are available through a paid subscription ("Vital Tails Premium"). Payment is processed through Google Play Billing, and subscription state is managed via RevenueCat.

b. Auto-Renewal

Subscriptions automatically renew at the end of each billing period unless canceled at least 24 hours before the renewal date. The renewal charge will be billed to your Google Play account.

c. Cancellation

You can cancel your subscription at any time through your Google Play account settings. Cancellation takes effect at the end of the current billing period; you will continue to have access to premium features until that time. No partial refunds are issued for unused portions of a billing period unless required by law.

d. Pricing Changes

We may change subscription prices from time to time. Any price change will be communicated to you in advance via the App or email and will take effect at your next renewal. You may cancel your subscription before the price change takes effect to avoid the new charge.

e. Refunds

Refund requests are handled by Google Play in accordance with their refund policy. We do not directly issue refunds. Visit Google Play's refund support page for more information.

5. Your Data

Vital Tails is designed to store the vast majority of your data locally on your device. We do not maintain a centralized database of your pet information.

• You are responsible for backing up your data. We are not responsible for data loss due to device failure, uninstallation, or other events
• The App provides an in-app export feature you can use to save copies of your data
• For information about what limited data does leave your device (e.g., subscription state, push tokens), see our Privacy Policy

6. Intellectual Property

The App, including all text, graphics, logos, icons, images, and software, is owned by Sky River Consulting and protected by intellectual property laws. Nothing in these Terms grants you any rights to our trademarks, logos, or other branding without our prior written permission.

You retain ownership of any data you create within the App (pet profiles, logs, photos, notes, etc.). By using the App, you grant us no rights to your data beyond what is necessary to provide the App's functionality.

7. Third-Party Services

The App relies on third-party services including Google Play Billing, RevenueCat, Expo Notifications, OpenStreetMap, and Google Maps. Your use of those services may be subject to their own terms and policies. We are not responsible for the practices of third-party services.

8. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The App will be uninterrupted, secure, or error-free
• Any data or information in the App is accurate, reliable, or current
• Defects in the App will be corrected

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SKY RIVER CONSULTING, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST DATA, OR HARM TO PETS.

Our total liability to you for any claim arising out of or relating to these Terms or the App shall not exceed the amount you paid us for subscriptions in the 12 months prior to the claim, or $50, whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

10. Indemnification

You agree to indemnify and hold harmless Sky River Consulting, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the App or your violation of these Terms.

11. Termination

We may suspend or terminate your access to the App at any time, with or without notice, for any reason, including violation of these Terms. You may stop using the App at any time by uninstalling it. Termination does not relieve you of any payment obligations incurred before termination.

The following provisions survive termination: Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, Governing Law, and Dispute Resolution.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Montana, United States, without regard to its conflict of law provisions.

13. Dispute Resolution

Any disputes arising out of or relating to these Terms or the App shall be resolved through binding arbitration in Montana, except that either party may bring small claims in their local small-claims court. You and we waive any right to a jury trial.

14. Changes to These Terms

We may update these Terms from time to time. Updates will be reflected on this page with a revised "Last updated" date. Continued use of the App after changes constitutes acceptance of the updated Terms. If you do not agree to updated Terms, you should uninstall the App.
